Welcome to ToonCap. By accessing or using this website, submitting captions, purchasing submission credits, rating captions, or participating in any contest hosted on ToonCap, you agree to these Terms and Conditions and Contest Rules. If you do not agree with these terms, you should not use this website.

Overview

ToonCap operates an online cartoon caption contest platform where users may submit captions for featured cartoons, rate captions submitted by others, and participate in skill-based contests hosted on the site.

Each contest winner is determined based on humor, creativity, and audience response through the contest voting system and judging structure described on the site.

ToonCap contests are games of skill, not games of chance.

ToonCap reserves the right to modify, suspend, or discontinue any contest, feature, or part of the website at any time.

Eligibility

Participants must be at least 18 years of age or the age of majority in their jurisdiction.

By entering a contest you confirm that your participation is lawful in your place of residence.

Residents of jurisdictions where such contests are prohibited are not eligible to participate.

To avoid additional regulatory requirements, contests may be void in the Province of Quebec.

Employees, contractors, judges, and individuals directly involved in administering a contest may not enter that contest.

Contest Period

Each contest begins and ends on the dates listed on the specific contest page.

Entries received after the contest closing time will not be eligible.

ToonCap reserves the right to extend, shorten, suspend, or cancel a contest if necessary due to technical issues, legal concerns, or other circumstances beyond its control.

How to Enter

To enter a contest, users must submit a caption through the submission form provided on the contest page.

Submission may require the purchase of a submission credit.

Each submission credit allows the user to submit one caption unless otherwise stated on the contest page.

Submission credits are non-transferable, have no cash value, and may only be used for caption submissions on ToonCap.

All entries must be received before the contest deadline.

Submitting a caption does not guarantee that it will be displayed, featured, shortlisted, or selected as a winner.

Skill-Based Judging

ToonCap contests are skill-based competitions designed to reward captions that demonstrate humor, creativity, and originality.

Contest winners are determined through a combination of evaluation methods which may include:

public caption ratings
a designated women’s vote
a rotating guest judge vote

Public ratings may include options such as Bad, OK, and Funny or other rating methods established by ToonCap.

The final scoring methodology may vary between contests and is determined at the discretion of ToonCap.

ToonCap reserves the right to break ties, verify results, remove fraudulent votes, or adjust scoring where necessary to preserve the integrity of the contest.

All judging decisions are final.

Anti-Fraud and Vote Integrity

To maintain fair competition, ToonCap monitors voting activity and user behavior.

ToonCap reserves the right to review and remove votes or disqualify entries where manipulation or fraudulent behavior is suspected, including but not limited to:

automated voting
bot activity
duplicate accounts
coordinated vote manipulation
spam activity

Accounts involved in fraudulent activity may be suspended or permanently banned.

Skill-Testing Question

In accordance with Canadian contest regulations, before being declared a winner and receiving any prize, a potential winner may be required to correctly answer a time-limited mathematical skill-testing question without assistance.

Failure to correctly answer the question may result in disqualification and selection of an alternate winner.

Prizes

Where prizes are offered, the details and approximate value will be listed on the contest page.

ToonCap reserves the right to substitute prizes of equal or greater value if necessary.

Before receiving a prize, winners may be required to:

verify eligibility
provide contact information
answer the skill-testing question
complete additional verification if required

If a potential winner cannot be contacted, fails verification, or does not respond within the required timeframe, ToonCap may select an alternate winner.

Winners are responsible for any tax obligations in their jurisdiction.

Caption Ownership and License

Participants retain ownership of the captions they submit.

However, by submitting a caption you grant ToonCap a worldwide, perpetual, non-exclusive, royalty-free license to use, reproduce, publish, display, distribute, adapt, and promote the caption in connection with the contest, the website, and ToonCap promotional materials.

This may include publication on:

the ToonCap website
contest result pages
social media
marketing materials
future promotional campaigns

ToonCap may edit captions for formatting, spelling, or clarity while preserving the substance of the caption.

Prohibited Content

Captions may not contain content that ToonCap determines to be:

illegal
defamatory
threatening
harassing
hateful or discriminatory
sexually explicit
excessively vulgar
misleading or deceptive

ToonCap reserves the right to remove any caption at its sole discretion.

User Conduct

Users may not interfere with the operation of the website or the fairness of contests.

Prohibited behavior includes but is not limited to:

attempting to manipulate voting systems
creating multiple accounts to influence results
submitting automated entries
impersonating another person

Violations may result in account suspension or termination.

Technical Issues

ToonCap is not responsible for entries, votes, or payments that are lost, delayed, misdirected, corrupted, or interrupted due to technical failures, internet disruptions, server issues, or software errors.

Limitation of Liability

To the fullest extent permitted by law, ToonCap and its operators are not liable for any loss, damage, injury, or expense arising from participation in any contest or use of the website.

Participation is voluntary and at the user’s own risk.

Privacy

Personal information collected through the website may include name, email address, and location.

This information may be used for:

contest administration
communication with users
verification of winners
displaying contest results

Payment processing is handled by third-party payment providers. ToonCap does not store credit card information.

Changes to These Terms

ToonCap reserves the right to modify these Terms and Contest Rules at any time.
